Constitution Rules

Section 1 - Preliminary

Name of Rule

(1) These Rules may be cited as the Constitution Rules.

Commencement

(2) The Constitution Rules commence on 1 July 2018 under resolution CNL 17/24.

Authority

(3) The Council of Macquarie University makes the following rules under section 29 of the Macquarie University Act 1989 and Part 10 of the Macquarie University By-law 2005.

Section 2 - Rule

Composition

(5) In accordance with section 4(1)(b) of the Macquarie University Act 1989 (the Act), the following Constitution Rules are prescribed for the purposes of standard governing body provisions:

(6) under section 8B(2) of the Act the total number of members of the Council is 15;

(7) under section 8B(4) of the Act the total number of members in each category is:

  1. three (3) official members under section 8H of the Act;
  2. four (4) elected members under section 8D of the Act being:
    1. two (2) academic staff members;
    2. one (1) non-academic staff member; and
    3. one (1) student member;
  3. six (6) Council appointed members being:
    1. at least two (2) Council appointed members who are external persons and graduates of Macquarie University appointed by Council under section 8E of the Act; and
    2. up to four (4) external members appointed by Council under section 8F of the Act; and
  4. two (2) members appointed by the Minister.

(8) The written notice to the Minister, in accordance with section 4(2) of the Universities Governing Bodies Act 2011 (NSW), will note:

  1. that the standard governing body provisions and the Constitution Rules are to commence on 1 July 2018; and
  2. for the purpose of enabling the Council to be duly constituted on or after commencement of the standard governing body provisions and the Constitution Rules, elections may be conducted and appointments made before that commencement date as if the standard governing body provisions and the Constitution Rules were in force.
